Terms of Service
These Terms of Service constitute a legally binding agreement between you and AWO Logistics LLC governing your access to and use of the Fahan application and related services.

1. Acceptance of Terms
By creating an account, downloading, installing, or using Fahan (the "Service"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
You represent you are at least 13 years old. If 13-18, parent/guardian must consent. If using for an organization, you have authority to bind it.
2. Description of Service
Fahan is a real-time AI voice translation application. It is NOT a certified translation service, medical device, legal interpretation service, or substitute for professional human interpreters where certification is legally required.
3. Account Registration
Agree to: provide accurate info, maintain credential security, not share accounts, notify of unauthorized use, accept responsibility for all account activity. We may suspend/terminate accounts used fraudulently or in violation.
4. Subscriptions, Pricing & Billing
4.1 Subscription Plans
Weekly and monthly plans at displayed prices. Subject to change with notice.
4.2 Free Tier
Lifetime-limited number of uses. Does NOT reset daily/weekly/monthly.
4.3 Auto-Renewal
Subscriptions auto-renew unless cancelled before renewal date.
4.4 Cancellation
Cancel anytime through App or app store. Takes effect at end of current period. No partial refunds.
4.5 Refunds
Handled by Apple App Store per their policies. Contact app store directly.
4.6 Usage Caps
Each tier has maximum speech duration (hours per week/month). Tracked server-side, enforced automatically.
5. Usage Limits & Fair Use
- Server-side enforcement
- Single device at a time
- Device verification via IP-derived identifier
- Any circumvention attempt = immediate termination
6. Acceptable Use Policy
You agree NOT to: engage in illegal/fraudulent activity, harass/threaten/abuse anyone, record another person's voice without consent, translate illegal/obscene/threatening content, reverse-engineer/decompile the Service, probe/scan vulnerabilities, interfere with or burden infrastructure, build competing products using the Service, resell/sublicense access, impersonate anyone, use automated bots/scrapers.
We reserve the right to investigate violations and may suspend/terminate access and refer to law enforcement.
7. Translation Accuracy Disclaimer
- Translations generated by AI, NOT reviewed by humans
- No guarantee of accuracy/completeness/reliability
- Quality validation catches empty outputs, repetitive garbage, and corrupted translations — but semantic errors may still pass
- Do not rely solely on Fahan for medical/legal/financial/safety decisions
- You assume all risk
8. Healthcare & Medical Use Disclaimer
- General-purpose communication aid, not designed/tested/certified for clinical use
- Healthcare providers should not rely solely on Fahan
- Does not satisfy legal obligations under Title VI, Section 1557 of ACA, HIPAA, or state laws
- AWO Logistics LLC expressly disclaims ALL liability for harm from reliance on translations in medical contexts
- Healthcare institutions should consult legal counsel before deployment
9. Intellectual Property
9.1 Our IP
The Service including app, website, software, algorithms, AI models, UI, design, logos, trademarks is owned by AWO Logistics LLC and protected by US and international law. No rights granted except limited use under these Terms.
9.2 Restrictions
No copying, modifying, distributing, selling, reverse-engineering, or creating derivative works.
10. User Content & Audio Data
You retain ownership of content submitted. You grant AWO Logistics LLC a limited, non-exclusive, worldwide, royalty-free license to process audio/text solely for providing translation, maintaining quality, and caching anonymized translations per Privacy Policy. We do not claim ownership of your words. We do not use your content to train AI models.
11. Third-Party Services
Service relies on third-party providers for speech recognition, translation, voice synthesis, payments, auth, hosting. They operate under their own terms. We contractually require appropriate security but are not responsible for third-party acts/omissions. Payments processed through Apple App Store.
12. Disclaimer of Warranties
Disclaims: merchantability, fitness for purpose, non-infringement, uninterrupted/error-free operation, accuracy of translations, quality of voice synthesis, meeting requirements.
Some jurisdictions don't allow exclusion of implied warranties. In those cases, liability limited to maximum extent permitted.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AWO LOGISTICS LLC SHALL NOT BE LIABLE FOR: indirect/incidental/special/consequential/punitive damages, loss of profits/revenue/data/goodwill, damages from reliance on translations, damages from unauthorized access/loss of data, damages from service interruption.
TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) TOTAL AMOUNT PAID IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) FIFTY US DOLLARS ($50.00).
14. Indemnification
You indemnify AWO Logistics LLC from claims arising from: your use, your violations, your violation of third-party rights, content you submit, your reliance on translations for high-stakes decisions, your recording/sharing conversations without consent.
15. Dispute Resolution & Arbitration
15.1 Informal Resolution
Contact us and attempt informal resolution for at least 30 days first.
15.2 Binding Arbitration
Unresolved disputes go to binding individual arbitration through American Arbitration Association (AAA) under Consumer Arbitration Rules. Takes place in Missouri or by phone/online.
15.3 Class Action Waiver
YOU AND AWO LOGISTICS LLC AGREE THAT EACH PARTY MAY BRING CLAIMS ONLY IN INDIVIDUAL CAPACITY AND NOT AS PLAINTIFF OR CLASS MEMBER IN ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
15.4 Exceptions
Small claims court if qualifying. Injunctive relief for IP violations.
16. Governing Law
Laws of the State of Missouri, United States, without conflict-of-law principles. Exclusive jurisdiction in Missouri state and federal courts.
17. Termination
17.1 By You
Delete account and uninstall. Cancel subscription through app store first.
17.2 By Us
May suspend/terminate at any time for any reason including violation, fraud, non-payment, harmful conduct.
17.3 Effect
Right to use ceases immediately. Sections 7, 8, 9, 12, 13, 14, 15, 16, 19, 20 survive termination.
18. Modifications to Terms
May modify Terms. Will update date and notify. Continued use = acceptance. If you disagree, stop using and delete account.
19. Severability
Invalid provisions modified to minimum extent or severed. Remaining provisions continue.
20. Entire Agreement
These Terms + Privacy Policy = entire agreement. Supersedes all prior agreements. No waiver is continuing.
